The legal aspect of the infrastructure development ensures the project complies with the rules and regulations for security, environmental protection, and quality. The US government funds the infrastructure development through various bonds or laws, such as the IIJA 2021 Act. 

Sometimes, for infrastructure development, the government may need private property; it can acquire the property by paying “just compensation” to the owner under the law. The US government also settled the civil lawsuit against infrastructure project owners and operators.

The US Justice Department holds the companies accountable for the damage and inconvenience caused by the infrastructure project under their administration as well. For instance, the recent Norfolk Southern Railway company will pay $310 million for the damage caused. 

What are the situations when the government issues compensation or settlement in Infrastructure? 

The federal government offers compensation or a settlement in the following situations in the infrastructure sector:

  • Land Acquisition: 
  • When the government needs to acquire private property for public use, the Fifth Amendment of the Constitution states that the government cannot acquire the private property for public use without just compensation. 
  • So, the government pays the private property owner the market value of the property for public use. 
  • Infrastructure causes harm: 
  • If the infrastructure project causes harm like pollution, affects public health, or affects the area, the government may have to compensate the affected people, or the operators have to compensate. 
  • Relocations: 
  • If the residents or businesses have to relocate to another place due to the infrastructure development, they may receive government compensation. 

How does the government’s Compensation settlement for land acquisition work?

The government has eminent domain power for acquiring private property for public use; however, under the Fifth Amendment, it must compensate for the land acquisition. The property owners will be paid through Just Compensation, which works in the following manner:

  • When the government acquires private property, it must determine its current market value at the time of acquisition based on the size and location. 
  • Once the fair market value was made it formed the NCDOT agreement with the property owner. 
  • If the settlement is more than $500,000, it is administered by the Right of Way Review Board, and if it is more than $1,000,000, it is approved by both the Right of Way Review Board and the Transportation Secretary.
  • So, if there are big settlements, it can take time to receive the compensation from the government. 

How does the Relocation compensation settlement work?

The Relocation government compensation comes under the Uniform Relocation Assistance and Real Property Acquisition Policies. The URA receives federal funding for relocation and infrastructure projects. 

This compensation ensures that the government pays the people who have to relocate from one place to another for infrastructure development. Let’s understand how the relocation compensation works:

  • Relocation compensation is offered for home relocation, business relocation, farm relocation, and organization relocation for infrastructure. 
  • For homeowners, the assistance is offered based on the market value of the home you acquired, and if the acquisition cost is more than the old house price, the compensation will be the difference between the two house prices. 
  • Tenants will receive compensation for moving and downpayment assistance under this compensation. 
  • Businesses, farms, and organizations will receive compensation for moving, relocation, business loss, and other costs, depending on the negotiation. 

How does the US issue compensation for the problems caused by the infrastructure?

If the infrastructure project causes harm to the environment, public health, or other harm to the community or individuals, the community can sue the government for compensation, or the government can take action against the project owner or operator.

If the user filed a complaint against the infrastructure projects, they can file it in the Consumer Protection agency, or the government itself can start an investigation against the project. For instance, the US State bagged the settlement of more than $100 million from Green Ocean Private Limited and Synergy Marine for the collapse of the Francis Scott Key Bridge. 

The USA government compensates the citizens for the land acquisition and relocation, as well as for the harm caused by the infrastructure projects under certain circumstances, or files cases against the operators or project owners to hold them accountable for the problems caused by the infrastructure.
